CFTC Investigates Kalshi Over Unusual Ether Trading Activity

The Commodity Futures Trading Commission (CFTC) is investigating Kalshi, a trading platform, following reports of nearly one million ether perpetual futures trades that occurred in nearly identical amounts. This unusual trading activity has raised concerns, particularly as over one third of these trades were clustered around the price of $5,500, contributing to more than $5 billion in trading volume in recent weeks, according to an analysis by The Wall Street Journal.

The CFTC is currently reviewing the trading patterns to determine if an enforcement investigation is warranted. Allegations of wash trading, which involves trades that lack genuine economic purpose and can mislead market participants, have emerged. However, Kalshi has denied these allegations, asserting that hundreds of distinct traders were involved and that the repeated trade sizes were due to market makers maintaining fixed resting orders that were frequently executed by faster traders.

Kalshi emphasized that it has mechanisms in place to prevent self-trading and monitor for coordinated wash trading. The company also stated that its liquidity programs incentivize market makers to maintain specific order sizes and spreads, rather than rewarding high trading volumes. Firms such as Jump Trading and Wintermute were noted as participants in the rapid transactions, with Jump asserting that it employs self-match prevention tools and does not coordinate with other traders.

This scrutiny from the CFTC comes as Kalshi seeks to expand its offerings in the perpetual futures market, having launched crypto perpetual contracts in May and currently pursuing regulatory approval for similar contracts linked to individual U.S. stocks.
