      CFTC Moves Forward with Crypto Regulations After Senate Bill Stalls

      Michael S. Selig, Chairman of the Commodity Futures Trading Commission (CFTC), expressed disappointment on October 5, 2026, after the Senate failed to advance the CLARITY Act, which aimed to clarify regulatory authority over digital assets. The bill fell short by one vote, with a procedural outcome of 49-50, highlighting the contentious nature of crypto legislation in the U.S.

      In response to the legislative setback, the CFTC announced two proposed rules aimed at regulating leveraged crypto trading. The first, Regulation Crypto Asset Transactions (CTX), focuses on retail trading using borrowed funds, which can amplify both gains and losses. The second, Regulation Crypto Asset Markets (CAM), establishes a federal registration pathway for trading platforms, requiring them to demonstrate proof-of-reserves to ensure they hold the customer assets they claim.

      Selig, who took office as CFTC Chairman in December 2025, emphasized the urgency of regulatory clarity in the crypto space. While the CFTC can proceed with these new rules under existing authority, broader oversight of spot crypto markets would still require Congressional approval. The failure of the CLARITY Act reflects ongoing divisions within Congress, particularly regarding ethical provisions related to digital assets.
