      CFTC Unveils New Framework for Crypto Trading Amid Legal Concerns

      The Commodity Futures Trading Commission (CFTC) has introduced a new plan aimed at regulating leveraged cryptocurrency trading, which does not require Congressional approval. On October 5, 2026, the agency published an advance notice of proposed rulemaking (ANPRM) that outlines two proposed frameworks: Regulation CTX, targeting leveraged and margined retail crypto transactions, and Regulation CAM, which establishes a new subcategory for crypto asset markets. This initiative offers exchanges a voluntary pathway to federal registration, contingent on meeting specific requirements such as proof-of-reserves obligations and anti-manipulation controls.

      CFTC Chairman Michael Selig has advocated for this rulemaking, leveraging the agency's existing authority under the Commodity Exchange Act. However, the CFTC's approach faces scrutiny following the Supreme Court's 2024 ruling in Loper Bright Enterprises v. Raimondo, which diminished the deference courts typically grant to agency interpretations of laws. Legal expert Renato Mariotti has described the CFTC's strategy as a clever interpretation of its powers but cautioned that courts may not be inclined to support it in the current legal climate.

      The proposed regulations do not impose specific caps on leverage; instead, any leveraged offerings will undergo review by CFTC staff prior to reaching customers. The framework's effectiveness will depend on the willingness of exchanges to pursue federal registration, as compliance could involve significant costs. The CFTC has acknowledged that its regulatory powers are limited without further Congressional action, especially in light of the recent legislative failure of the CLARITY Act, which aimed to establish a comprehensive oversight framework for crypto markets. Comments on the ANPRM are expected within 60 days, and the responses from major exchanges will be closely monitored as the situation develops.
