The regulatory exemption extends for five years and includes stringent compliance requirements.
TSV operators must confirm that tokenized securities maintain equivalent rights to conventional equity shares, encompassing dividend payments and shareholder voting privileges. Smart contract infrastructure must be publicly accessible, auditable, and launched on permissionless blockchain platforms. Stock issuers retain authority to refuse and prevent their securities from trading on any TSV platform.
Trading suspensions implemented on primary exchanges automatically extend to tokenized counterparts. TSV platforms must operate as U.S. entities and maintain full compliance with OFAC sanctions protocols.
Bernstein research analysts had forecasted that the SEC and CFTC would pursue “aggressive and swift” regulatory action following the CLARITY Act’s failure. Thursday’s exemption represents the initial tangible evidence of this regulatory approach materializing.
Market Response to PURR
PURR is being interpreted by market participants as a primary beneficiary of this regulatory development. The SEC’s directive mandates trading on public permissionless blockchain networks with transparent smart contracts, which aligns substantially with Hyperliquid’s decentralized exchange architecture.

Nine Wall Street analysts track PURR with a unanimous Buy recommendation and a collective price target of $19.80. Cantor Fitzgerald elevated its price objective to $34.20 on September 10. Compass Point launched coverage with a Buy rating and $18.00 target on September 15. Chardan Capital increased its target to $17.00 on August 28.
PURR represents 100% of holdings in both the Bitwise Hyperliquid ETF (BHYP) and the Grayscale Hyperliquid Staking ETF (HYPG). This concentrated exposure means capital flows into and out of these exchange-traded funds create direct buying and selling pressure on the underlying stock.
