      The scheduled vote represents a cloture motion for the Digital Asset Market Clarity Act, commonly referred to as the CLARITY Act. A threshold of 60 votes is required simply to advance the measure to full floor debate — this procedural step doesn’t ensure final passage.

      In July 2025, the House of Representatives approved its version with a 294–134 vote, gaining support from 78 Democratic members. The Senate Banking Committee cleared a companion measure with a 15–9 vote in May 2026, though a more comprehensive version subsequently lost momentum.

      Prediction market sentiment has shifted dramatically. Current probabilities for 2026 passage stand around 14%, a steep decline from the 82% odds recorded in February. Democratic lawmakers have requested enhanced provisions addressing political officials’ involvement with cryptocurrency earnings before offering their backing.

      CFTC Chairman Michael Selig has indicated the agency possesses sufficient authority under current regulations to oversee cryptocurrency markets. Additionally, on August 18, the SEC published its Regulation Crypto Assets framework, which incorporates several definitional elements aligned with the CLARITY Act.

      On August 31, cryptocurrency analyst XrpArab shared insights suggesting CFTC Chairman Michael Selig appears optimistic regarding the September 15 Senate proceedings. The analyst highlighted unresolved matters requiring attention and emphasized the ramifications should the cloture motion fail ahead of the October election recess.

      XRP-focused exchange-traded funds documented their highest weekly capital inflows on record, totaling $110.49 million. August 28 witnessed particularly strong activity with net inflows reaching $26.20 million in a single day, elevating cumulative net inflows to $1.66 billion.

      CME Derivatives Market Share Expands While Overall Leverage Contracts

      Open interest in CME XRP futures expanded from 284 million tokens to 387 million tokens between August 17 and August 31, representing approximately 36% growth. CME’s share of total XRP futures exposure climbed to roughly 17%, up from 10% in mid-August.

      Aggregate XRP open interest across all trading platforms declined from 2.77 billion tokens to 2.34 billion tokens over this timeframe, despite XRP’s price appreciating nearly 40%.

      CFTC positioning data through August 25 revealed leveraged funds maintaining net short positions of approximately 116 million XRP, more than doubling from the previous week’s 57 million XRP. Dealers increased net-long positions by roughly 60 million XRP, while asset managers expanded holdings by approximately 28 million tokens.
