Arkansas Appeals Court Considers Foreign Bitcoin Mining Ownership Restrictions

The Eighth Circuit Court of Appeals is currently deliberating on whether to lift an injunction that prevents Arkansas from enforcing its ban on certain foreign-controlled Bitcoin mining operations. This legal battle centers around two state laws, Act 636 from 2023 and Act 174 from 2024, which aim to restrict businesses controlled by foreign entities linked to countries on the U.S. International Traffic in Arms Regulations list from participating in the state's digital asset mining sector.

The challenge to these laws was initiated by Jones Eagle LLC, a company led by Qimin 'Jimmy' Chen, a naturalized U.S. citizen originally from China. Jones Eagle contends that the Arkansas laws conflict with federal regulations governing foreign affairs and investment. In response to the lawsuit, a federal district judge issued a temporary restraining order in November 2024, followed by a preliminary injunction in December 2024, indicating that the plaintiffs were likely to succeed in their claims against the state restrictions.

The Eighth Circuit has heard arguments regarding this case on multiple occasions, most recently on October 20, 2026. Arkansas officials argue that the laws pertain to land use, a traditional area of state authority, and align with national security policies. In contrast, Jones Eagle asserts that the state is overstepping by engaging in foreign policy matters. The court's decision on whether to maintain the injunction will have significant implications for foreign-owned mining operations in Arkansas and could influence similar legislative efforts in other states.
