CFTC Pledges Clear Crypto Rules With or Without…
The U.S. Commodity Futures Trading Commission is moving ahead with cryptocurrency regulation despite Congress's failure to enact comprehensive digital-asset legislation, proposing a federal framework for certain crypto trading platforms under its existing statutory powers. On October 5, CFTC Chairman Michael Selig announced an advance notice of proposed rulemaking covering retail cryptocurrency transactions involving leverage, financing or margin. The initiative introduces two proposed regulatory frameworks, Regulation Crypto Asset Transactions (CTX) and Regulation Crypto Asset Markets (CAM).The announcement follows the Senate's rejection of the CLARITY Act, which would have established a broader division of responsibilities between the CFTC and Securities and Exchange Commission. Selig argues that existing law already gives federal regulators meaningful authority to establish clearer rules without waiting for Congress. However, the agency's proposal is narrower than the comprehensive market-structure legislation lawmakers considered. It focuses on particular leveraged retail commodity transactions rather than establishing universal federal supervision of cryptocurrency spot markets.
CFTC Proposes Federal Registration for Crypto Exchanges
The proposed framework would create a pathway for qualifying cryptocurrency exchanges to register with the CFTC and operate under a uniform national regulatory structure. Under Regulation CAM, registered platforms would face requirements addressing market manipulation, customer protections and proof of reserves. Regulation CTX would govern eligible retail commodity transactions involving cryptocurrency assets. The framework relies principally on Section 2(c)(2)(D) of the Commodity Exchange Act, which brings certain leveraged, margined or financed retail commodity transactions within the CFTC's jurisdiction.Selig described federal registration as an alternative to existing state-level licensing arrangements rather than a mandatory replacement for them. Exchanges could choose the federal framework where their products and business models qualify, while other operators could continue using applicable state regulatory pathways. The CFTC also proposes requiring registered futures commission merchants to intermediate customer transactions on participating platforms.That arrangement would introduce regulated intermediaries between customers and trading venues, potentially changing how exchanges manage execution, customer assets and compliance. Specific leverage limits have not yet been established. Those parameters would require further regulatory consideration and approval. Importantly, the October 5 publication is an advance notice seeking public comments, not a finalized rulebook. The agency must evaluate responses and undertake additional rulemaking before binding requirements can take effect.Congressional Defeat Leaves Important Regulatory Gaps
The initiative comes after the CLARITY Act failed to secure sufficient Senate support, leaving the United States without the comprehensive cryptocurrency market-structure legislation sought by parts of the industry. The legislation would have expanded the CFTC's authority over digital commodities and established clearer boundaries between securities and commodities regulation. Its failure means the agency must operate within its existing statutory jurisdiction. That limitation is significant for ordinary cryptocurrency spot trading.While the CFTC possesses enforcement authority against fraud and manipulation in commodity spot markets, it does not currently have comprehensive supervisory authority over every exchange offering fully paid cryptocurrency transactions. Only Congress can establish a mandatory federal registration regime covering the wider category of crypto spot exchanges. The SEC is pursuing complementary measures, including proposed changes to investment-adviser crypto custody requirements and potential exemptions for tokenized securities. The agencies have also coordinated on digital-asset classification, including a March 17 interpretation clarifying the application of federal securities laws to certain cryptocurrencies and transactions.Together, these initiatives represent an effort to replace regulatory uncertainty with more explicit requirements using existing legislation. Nevertheless, agency rulemaking cannot fully substitute for congressional action. Regulations developed under existing statutes may face legal challenges and remain more susceptible to changes in administrative policy than legislation enacted by Congress. For cryptocurrency businesses, the immediate development is therefore a proposed additional route into federal supervision, not the completion of a nationwide regulatory framework. The CFTC intends to proceed without waiting for lawmakers, but Congress remains necessary to close the remaining gaps in U.S. crypto market oversight.Source: FinanceFeeds
