      Former Senator Blanche Lincoln Advocates for Kalshi Amid Regulatory Debate

      Blanche Lincoln, a former U.S. Senator from Arkansas, has shifted from warning against the potential risks of prediction markets to lobbying for Kalshi, a platform that offers event contracts including those related to sports. In 2010, during discussions surrounding the Dodd-Frank Wall Street Reform and Consumer Protection Act, Lincoln cautioned that such markets could serve as a loophole for sports gambling, labeling them as 'pure gambling.' Now, she is advocating for these contracts to be regulated at the federal level by the Commodity Futures Trading Commission (CFTC).

      In her recent lobbying efforts, Lincoln's firm, Lincoln Policy Group, filed comments urging the CFTC to assert exclusive jurisdiction over prediction markets, arguing that a fragmented state-by-state regulatory approach would create confusion and hinder commerce. She emphasized the commercial implications of these contracts, which are intertwined with advertising, merchandise sales, and hospitality, contrasting her current position with her earlier warnings.

      Lincoln registered as a lobbyist for Kalshi in 2024 and has received $180,000 from the company for her services. Her involvement extends to supporting Kalshi in legal matters, including an amicus brief filed with the Third Circuit Court, which has sided with Kalshi on the issue of federal preemption over state gambling laws. This legal strategy hinges on the argument that if sports event contracts are classified as federally regulated derivatives, they should not be subject to state gambling regulations.

      The ongoing legal battle has seen mixed rulings, with the Third Circuit favoring Kalshi while the Sixth and Ninth Circuits have ruled against it. Lincoln's advocacy is significant as it draws on her experience in shaping the Dodd-Frank Act, which established the regulatory framework for event contracts. Her dual role as a lawmaker and now a lobbyist raises questions about the interpretation of congressional intent regarding these financial products, as traditional sportsbooks and state regulators closely monitor the situation.
