XRP at $1.29 After the CLARITY Act Failed 49-50: What…
Updated 16 September 2026
XRP: $1.29, down 8.0 percent over 24 hours, market capitalisation about $81.1 billion (CoinGecko, 16 September, 06:40 UTC).
Verdict: the CLARITY Act's failure was the market's base case, but XRP has still broken the $1.31 to $1.33 support that analysts flagged pre-vote. Bear $0.90, base $1.33, bull $1.42 - and the Fed decides at 2:00pm ET today.
Key facts
- The cloture vote failed 49-50 on Tuesday 15 September. The Digital Asset Market Clarity Act needed 60 votes to advance and finished 11 short.
- All Democrats voted no, joined by four Republicans: Susan Collins of Maine, Josh Hawley of Missouri, Jerry Moran of Kansas and Thom Tillis of North Carolina.
- XRP trades at $1.29, down 8.0 percent in 24 hours - a bigger fall than Bitcoin at $75,783 (-2.1 percent) or Ethereum at $2,393 (-3.8 percent).
- XRP has lost the level that mattered. Pre-vote analysis put support at $1.31 to $1.33 and resistance at $1.38 to $1.42. Spot is now below the support band.
- The market had already priced this. Prediction markets put the odds of CLARITY becoming law in 2026 just below 20 percent going into the vote, which is why the move is a repricing rather than a shock.
- The failure ends market structure legislation in the Senate for 2026, according to reporting from CNBC and CoinDesk, after years of industry lobbying.
What the bill would have done, and what its failure actually changes
The CLARITY Act was the crypto industry's attempt to settle the question that has defined XRP's entire legal history: who regulates what. The bill would have divided oversight between the Securities and Exchange Commission and the Commodity Futures Trading Commission, set registration requirements for digital asset issuers and intermediaries, and strengthened anti-money-laundering protections.
Republican leaders released a revised version on Sunday that added ethics restrictions intended to address Democratic concerns about public officials profiting from crypto ventures. Those changes were not enough. The revision brought no Democrats across, and it did not hold four Republicans.
Here is the part that matters for XRP specifically, and it is more nuanced than the price action suggests. XRP's own regulatory position does not get worse because CLARITY failed. What the bill would have delivered is a statutory framework - certainty written into law rather than resting on litigation outcomes and agency posture. Its failure means that framework does not arrive in 2026. It does not reimpose anything that was previously removed.
The practical consequences are about what does not happen next: no statutory boundary between SEC and CFTC jurisdiction, no codified registration pathway for exchanges and issuers, and institutional allocators who were waiting for legislative clarity before committing continue to wait. For a token whose thesis is institutional payments adoption, the last of those is the real cost.
Why XRP fell harder than Bitcoin
XRP's 8.0 percent decline against Bitcoin's 2.1 percent is not random. XRP carries more legislative beta than any other large-cap token because its use case - cross-border settlement through regulated financial institutions - is the one that most depends on counterparties knowing which regulator governs it. Bitcoin's commodity status is not seriously contested. XRP's institutional adoption path runs directly through the questions CLARITY would have answered.
The timing compounded it. Bitcoin fell below $76,000 on the news, and the whole complex is now selling into a Federal Reserve decision that lands at 2:00pm ET today, where a 25 basis point hike is priced at roughly 81 to 91 percent across CME FedWatch, Kalshi and Polymarket. Risk assets rarely absorb a legislative defeat and a first rate hike since 2023 in the same 24 hours without a wider discount.
Pre-vote analysis had mapped this fork explicitly: if the vote failed without a matching drop in Bitcoin, XRP would likely hold near $1.40; if the vote failed and the broader market dropped with it, XRP would head toward $1.20. The second path is the one that is playing out.
Levels and scenarios
Spot is $1.29. The anchors below come from published pre-vote analysis of exactly this outcome, carried forward to where price actually is.
| Scenario | Level | Anchor and what gets you there |
|---|---|---|
| Bear | $0.90 -30 percent | The upper edge of the $0.70 to $0.90 worst-case floor from XRP's two-week Gaussian channel in the no-CLARITY scenario. Requires a hawkish dot plot today on top of the legislative defeat, with no re-filing signal from the Senate. |
| Base | $1.33 +3.1 percent | Reclaiming the top of the $1.31 to $1.33 support band that just broke. Needs the Fed to deliver the priced hike without escalating the 2027 path, letting the crypto complex stabilise and XRP retake lost ground. |
| Bull | $1.42 +10.1 percent | The top of the pre-vote $1.38 to $1.42 resistance band. This is the level XRP was projected to hold had the bill failed without a broad market drawdown, so it requires both a dovish Fed surprise and a credible signal that market structure legislation returns in 2027. |
One caveat on the downside. Some analysts have floated figures as low as $0.29 on prolonged regulatory uncertainty. That is not in the table because it assumes a multi-quarter stalemate that nothing in Tuesday's vote establishes - a cloture failure is a blocked procedural vote, not a repeal.
Quick Take
Do not confuse a legislative defeat with a legal one. XRP's own status is unchanged; what died on Tuesday is the timetable for putting crypto market structure into statute. With prediction markets already pricing CLARITY's passage below 20 percent, the 8 percent drop is better read as the removal of residual optionality plus Fed-day risk than as a re-rating of XRP's fundamentals. The level to watch is $1.31 to $1.33: reclaiming it says the market has finished repricing, and failing to says the selloff still has the Fed leg to run.

FAQ
What is the XRP price today?
XRP trades at $1.29 as of 16 September 2026, 06:40 UTC, down 8.0 percent over 24 hours, with a market capitalisation of roughly $81.1 billion (CoinGecko).
What happened with the CLARITY Act vote?
The Senate cloture vote on the Digital Asset Market Clarity Act failed 49-50 on 15 September. Cloture requires 60 votes, so the bill fell 11 short and did not advance to debate.
Who voted against it?
All Democratic senators voted no, joined by four Republicans: Susan Collins of Maine, Josh Hawley of Missouri, Jerry Moran of Kansas and Thom Tillis of North Carolina. A revised version released on Sunday added ethics restrictions on public officials profiting from crypto ventures, but it did not change the arithmetic.
Does this make XRP a security again?
No. The vote does not change XRP's existing legal position or reverse any prior determination. CLARITY would have created a statutory framework dividing SEC and CFTC oversight. Its failure means that framework does not arrive in 2026 - it does not reinstate anything.
Why did XRP fall more than Bitcoin?
XRP's institutional payments thesis depends more directly on regulatory certainty than Bitcoin's commodity status does, so it carries more legislative beta. XRP fell 8.0 percent against Bitcoin's 2.1 percent and Ethereum's 3.8 percent.
Was the failure a surprise?
Not to markets. Prediction markets priced the odds of CLARITY becoming law in 2026 at just under 20 percent heading into the vote, meaning failure was already the base case. That is part of why the reaction, while sharp, was a repricing rather than a capitulation.
What happens to crypto market structure legislation now?
Reporting from CNBC and CoinDesk indicates the failure effectively ends market structure legislative work in the Senate for 2026. Any renewed effort would most likely be a 2027 matter, with a different vote count and probably a different bill.
What should XRP holders watch today?
The Federal Reserve decision at 2:00pm ET. A 25 basis point hike is priced at roughly 81 to 91 percent across CME FedWatch, Kalshi and Polymarket, so the decision itself is largely in the price. The dot plot in the Summary of Economic Projections is the variable that is not.
