Wyoming’s Senator Cynthia Lummis has issued an urgent call for Senate action on the CLARITY Act, cautioning that inaction could derail the cryptocurrency industry’s regulatory framework for half a decade.
In a September 6 post on X, Lummis emphasized that should the CLARITY Act fail during this Congressional term, the industry would face a waiting period extending to 2030 before another viable opportunity for market structure legislation emerges.
“By completing this legislative process now, we can prevent the loss of countless years of potential growth in employment, capital investment, and government revenue,” Lummis stated.
Understanding the CLARITY Act’s Purpose
The CLARITY Act aims to resolve the ongoing regulatory ambiguity surrounding digital assets throughout the United States. The legislation establishes clear criteria for determining whether a digital asset qualifies as a security or commodity, while delineating jurisdictional boundaries between the Securities and Exchange Commission and the Commodity Futures Trading Commission.
After successfully navigating the House of Representatives in July 2025, the bill has remained in Senate limbo for more than twelve months without receiving a conclusive vote.
The Senate has scheduled a procedural motion for September 15. This preliminary vote will not enact the legislation but rather determine whether debate can be concluded and the legislative process can advance.
Republican Representative French Hill recently acknowledged that “negotiations have progressed to a meaningful stage,” though industry observers maintain that significant barriers persist.
Critical Roadblocks Preventing Advancement
Democratic legislators are refusing to back the bill unless specific ethics-related provisions are incorporated. These provisions remain unresolved at present.
According to CoinDesk reporting, achieving final passage before the November midterm elections appears effectively impossible. The House intends to conduct its own concluding vote immediately following Senate proceedings, scheduled just ahead of Election Day.
Congress operates on two-year legislative cycles. Should the bill fail to pass during the current session, it must be completely reintroduced in the subsequent Congress, starting the entire process anew.
Lummis has established herself as among the Senate’s strongest cryptocurrency advocates, having previously proposed legislation to incorporate Bitcoin into United States strategic reserve holdings.
Several market analysts suggest that even with legislative delays, near-term market consequences may prove minimal. Institutional investment has continued flowing steadily since spot Bitcoin exchange-traded funds received regulatory approval, while stablecoin legislation progresses through independent channels.
Current Cryptocurrency Market Conditions
Bitcoin was changing hands around $79,000 on September 7, registering a 0.03% decline across 24 hours while posting a 3.01% gain over the preceding seven days.
Ethereum traded at $2,506, climbing 0.39%. Ripple exchanged at $1.41, declining 0.47%.
The Crypto Fear and Greed Index measured 75, firmly within “greed” parameters.
The Korea premium for Bitcoin registered at 1.48%, indicating that South Korean exchange prices maintained a modest premium over international market rates.
