CFTC Excludes Casino Sportsbooks from Swap Definition

On October 9, 2026, the Commodity Futures Trading Commission (CFTC) issued an Interim Final Rule that clarifies the regulatory status of casino-style gambling products, stating that they do not qualify as derivatives under the Commodity Exchange Act. This ruling specifically excludes state- and tribal-licensed gambling products, such as sports wagers and casino table games, from federal derivatives oversight, allowing them to continue operating under existing state and tribal regulations.

The rule, identified as Release No. 9309-26, will take effect upon its publication in the Federal Register, initiating a 30-day comment period for public feedback. To be excluded from the swap definition, products must pass both a Provider Test, which requires offerings to come from licensed operators, and a Product Test, which stipulates that the products must not be exchange-traded. This distinction separates traditional casino bets from contracts listed on regulated markets.

CFTC Chairman Michael S. Selig emphasized that the ruling serves to clarify regulatory boundaries rather than alter existing policy. The interim rule ensures that licensed operators maintain their previous regulatory framework, while a separate proposal seeks to classify certain event contracts related to sports and politics as swaps, which remains open for public comment. The outcome of this proposal could significantly impact the federal oversight of the event contract market.
