      CFTC Submits Crypto Market Regulation Proposal to White House

      The Commodity Futures Trading Commission (CFTC) has submitted a new regulatory proposal concerning cryptocurrency transactions and markets to the Office of Information and Regulatory Affairs (OIRA) in the United States. This submission, designated as RIN 3038-AF80, was filed on September 17, 2026, shortly after the Senate's decision to block the CLARITY Act, which aimed to provide a clearer regulatory framework for digital assets.

      The OIRA has categorized this submission as being at the prerule stage, which allows for a preliminary review process. Under Executive Order 12866, OIRA has 10 working days to assess such preliminary actions, compared to the 90 days allocated for proposed and final rules. This submission marks the only pending action from the CFTC awaiting review by the White House.

      Currently, Michael Selig serves as the sole commissioner of the CFTC, which may influence the agency's direction and priorities in the evolving landscape of cryptocurrency regulation. The outcome of this regulatory proposal could have significant implications for the future of crypto markets in the United States.
