      Federal Judge Rules in Favor of Kalshi and Coinbase in Illinois Sports Contracts Case

      On October 2, 2026, a federal judge in the United States granted a partial preliminary injunction favoring Kalshi and Coinbase in their legal battle concerning the regulation of sports event contracts in Illinois. US District Judge Martha M. Pacold determined that certain licensing requirements imposed by Illinois likely conflict with federal derivatives law, specifically the Commodity Exchange Act (CEA). This ruling aligns with the stance of the Commodity Futures Trading Commission (CFTC), which is co-plaintiff in the case, asserting that these contracts should fall under federal jurisdiction rather than state gambling regulations.

      The court's decision primarily focused on the legal doctrine of preemption, which allows federal law to override state law in cases of conflict. Judge Pacold's ruling suggests that if Kalshi's sports event contracts are classified as swaps under the CEA, they would be exclusively regulated by federal authorities. However, the judge did not address the state's transaction fee rules, leaving that issue unresolved and requiring further legal briefs from both parties.

      Kalshi, which has been a CFTC-registered designated contract market since November 2020, began offering trading on sports event contracts in January 2025. Coinbase joined the effort in December 2025 through a partnership with Kalshi to provide its users access to these contracts. The ongoing legal disputes in Illinois reflect a broader national conversation regarding the regulation of sports-related contracts, with varying court opinions across different states regarding the appropriate regulatory authority. The outcome of this case could have significant implications for the future of prediction markets and cryptocurrency platforms operating in the United States.
