      Independent Community Bankers of America Sues OCC Over Trust Licenses for Cryptocurrency Firms

      The Independent Community Bankers of America (ICBA) has initiated a lawsuit against the Office of the Comptroller of the Currency (OCC) in a federal court, claiming that the OCC has exceeded its authority by granting national trust bank charters to cryptocurrency companies. The ICBA argues that this action allows these firms to enter the U.S. banking system without the same regulatory scrutiny faced by community banks, thereby creating an uneven competitive landscape.

      The ICBA, which advocates for small banking institutions in the United States, contends that the OCC's actions are not supported by the National Bank Act. The organization has expressed concerns that the OCC is implementing broad powers that could undermine the stability and competitiveness of smaller banks. ICBA President and CEO Rebeca Romero Rainey emphasized that the national trust charter was not intended to serve as a means for cryptocurrency companies to gain access to the banking system without adhering to the same regulatory requirements as traditional banks.

      The lawsuit comes on the heels of the ICBA's opposition to the Digital Asset Market Structure Bill, which was recently stalled in the U.S. Senate. The ICBA criticized the bill's provisions regarding stablecoins, arguing that they do not adequately protect community banks from increased competition for deposit accounts. The OCC has continued to issue trust charters to cryptocurrency firms, including Protego, Erebor, Coinbase, Circle, and Crypto.com, which operate under different business models than conventional community banks and do not provide cash deposit accounts requiring Federal Deposit Insurance Corporation (FDIC) insurance.
