      SEC's Jamie Selway Advocates for Bipartisan Support in Tokenization and Crypto Regulation

      Jamie Selway, the Director of the U.S. Securities and Exchange Commission's (SEC) Division of Trading and Markets, is advocating for a bipartisan approach to the regulation of tokenized securities and cryptocurrencies. He argues that modernizing financial markets through digital assets should be a shared goal across political lines. The SEC is working on a regulatory framework that treats tokenized securities under existing laws, ensuring that they do not receive special treatment or face additional penalties.

      On September 17, 2026, the SEC introduced an 'Innovation Exemption' that allows trading venues to operate without full exchange registration for a period of five years. This exemption is particularly significant for venues looking to trade tokenized National Market System (NMS) stocks, which are commonly listed on major U.S. exchanges. The exemption also permits the establishment of automated market maker (AMM)-style liquidity pools for these tokenized stocks, potentially transforming how these assets are traded.

      Selway's push for bipartisan support is crucial as digital asset legislation has faced delays in the U.S. Senate. Without Congressional action, the SEC is effectively shaping the regulatory landscape through exemptions and guidance. Major exchanges like Nasdaq and the New York Stock Exchange have expressed interest in developing platforms for trading tokenized securities, indicating a growing acceptance of this market innovation.

      Additionally, Selway has emphasized the need for better coordination between the SEC and the Commodity Futures Trading Commission (CFTC) regarding swap reporting and portfolio margining. He has also linked his tokenization framework to discussions about extending equity market trading hours beyond the traditional 9:30 AM to 4:00 PM Eastern time window, leveraging blockchain technology to facilitate 24/7 trading and improve liquidity during off-peak hours.
