Crypto Industry Presses Illinois Court for Expedited Ruling on Digital Asset Tax

      TLDR

      • Two prominent cryptocurrency advocacy organizations have petitioned an Illinois court to accelerate proceedings on the state’s controversial 0.2% digital asset levy.
      • The motion references ongoing litigation from both the Crypto Council for Innovation/Blockchain Association and a separate case brought by the Digital Chamber alongside the Illinois Blockchain Association.
      • State authorities have already pushed back the tax implementation date by half a year, from January 1, 2027, to July 1, 2027.
      • Should the court grant the expedited timeline, a ruling could arrive as early as March.
      • The Blockchain Association’s current CEO, Summer Mersinger, will step down this Friday, with predecessor Kristin Smith returning in an interim capacity.

A pair of prominent cryptocurrency advocacy organizations has escalated legal efforts to challenge Illinois’s newly enacted digital asset taxation framework. The Crypto Council for Innovation alongside the Blockchain Association are urging judicial authorities to expedite their assessment of the tax’s constitutional validity.

The organizations submitted their motion Tuesday in the Circuit Court of Sangamon County. Their filing requests court approval for an accelerated summary judgment timeline.

Summary judgment enables judicial resolution without proceeding to a full courtroom trial. In their petition, the advocacy groups expressed their desire “to reach a decision on the tax’s lawfulness as quickly as possible.”

Dual Legal Challenges Confront Illinois Digital Asset Levy

The motion highlighted both the lawsuit initiated by these two organizations against Illinois state authorities and a concurrent legal action pursued by the Digital Chamber working alongside the Illinois Blockchain Association.

At the heart of both legal challenges sits the Digital Asset Tax Act, legislation that imposes a 0.2% levy on cryptocurrency holdings within state boundaries.

Earlier in the month, Illinois lawmakers consented to a six-month postponement of the tax. Originally scheduled to commence January 1, 2027, enforcement will now begin July 1, 2027.

This postponement emerged from negotiations in the Digital Chamber’s lawsuit. That organization contended the taxation measure had been “slipped into the state’s budget” without proper legislative deliberation or opportunity for public input.

Digital Chamber CEO Cody Carbone stated at that time the organization would maintain its legal challenge. He emphasized they would continue “until this tax is struck down for good.”

CCI CEO Ji Kim acknowledged the delay offers some relief, though emphasized the necessity of a final judicial determination. “While pausing enforcement of the Digital Asset Tax Act protects Illinois consumers and businesses from this onerous and legally flawed tax until July 1, it remains imperative that the merits are determined as soon as possible,” Kim stated.

Leadership Transition Underway at Blockchain Association

This court petition arrives during a period of leadership transition within the Blockchain Association. CEO Summer Mersinger’s final day is scheduled for Friday.

Mersinger assumed her position with the advocacy organization last year. She accepted the role following her departure from the US Commodity Futures Trading Commission.

Kristin Smith, who previously served as the organization’s CEO, will assume interim leadership responsibilities. Mersinger plans to remain affiliated with the organization through the end of 2026.

Currently, the Illinois cryptocurrency tax remains suspended. Enforcement cannot proceed before July 1, 2027.

The accelerated procedural schedule proposed by the advocacy groups awaits judicial approval. If granted, a substantive ruling on the legislation’s merits could materialize by March, providing several months’ clarity ahead of the rescheduled tax implementation date.
