This setback was discussed by a panel of former U.S. financial regulators at the Avalanche Summit on September 16, where they explored the implications of the bill's defeat and the future of cryptocurrency regulation.

      The panel featured notable figures including former Commodity Futures Trading Commission (CFTC) Chairs J. Christopher Giancarlo and Timothy Massad, along with former Securities and Exchange Commission (SEC) Commissioners Troy Paredes and Caroline Crenshaw. The discussion highlighted the ongoing challenges in defining the regulatory boundaries between securities and commodities, a distinction that has eluded regulators and market participants for years. Giancarlo, known for his supportive stance towards the crypto industry, noted that current SEC and CFTC leadership still have the authority to implement regulations without new legislation.

      Despite the bill's failure, the panelists emphasized the importance of interagency cooperation and the potential for existing regulatory frameworks to address the evolving digital asset landscape. However, they acknowledged that administrative guidance lacks the permanence of congressional legislation, raising concerns about the stability of any regulatory measures that may be enacted in the future. The discussions underscored the complexities and political challenges surrounding cryptocurrency legislation in the United States.
