      Florida Court Orders Fundsz Promoters to Pay Over $30 Million in Fraud Case

      A federal judge in Florida has ruled that two promoters of the Fundsz platform must pay over $30 million following a fraud case involving more than 9,000 investors. The judgment, issued on September 30, 2026, was in favor of the U.S. Commodity Futures Trading Commission (CFTC) against Brian Early and Alisha Ann Kingrey, who were board members of Fundsz.

      The total financial penalty amounts to approximately $31.48 million, which includes $15.73 million in restitution for defrauded investors and a civil monetary penalty of $15.75 million. Additionally, the court has imposed permanent injunctions on both defendants, prohibiting them from trading and registering with the CFTC.

      The CFTC's allegations indicated that Fundsz attracted investors with promises of high returns exceeding 3% per week, purportedly generated through trading in digital assets and precious metals. However, the agency claimed that the algorithm responsible for these returns did not exist, and the promoters made significant misrepresentations regarding expected profits and investment risks.

      The civil action was initiated by the CFTC on July 31, 2023, against Early, Kingrey, and the platform's founder, Rene Larralde, who passed away in 2023. While approximately $4 million has been recovered from Larralde's estate, the remaining amount owed to investors remains uncertain, raising questions about the potential for further asset recovery and the ability of Early and Kingrey to fulfill their financial obligations.
