XRP Price at $1.40 Before the CLARITY Act Cloture Vote:…
Updated 15 September 2026, before the Senate vote. XRP trades at $1.40 (CoinGecko, 09:06 UTC). The Senate votes at approximately 2:15pm ET today on cloture on the motion to proceed to H.R.3633, the Digital Asset Market Clarity Act, and needs 60 votes. Polymarket prices the bill becoming law in 2026 at 18.5% (09:03 UTC), down 12 points in 24 hours. Verdict: a procedural vote, not passage - a clean cloture win is not what the market is priced for, a failure mostly is.
The number XRP holders are watching today is not a price. It is 60 - the votes the Senate needs this afternoon to move the CLARITY Act, the market-structure bill that would decide which US regulator oversees tokens such as XRP in the spot market, onto the floor for debate. Going into that vote, XRP sits at $1.40, up 39.5% over 30 days but down 52.9% over a year (CoinGecko, 09:06 UTC), and the prediction market that tracks the bill has just cut its odds of becoming law this year to 18.5%. The gap between those two numbers - a token that rallied into the vote and a market that has stopped believing in the bill - is what this afternoon resolves.
This is a day-of piece. The background - what the vote is, and why it matters for XRP's ETF run - is in our 2 September explainer on the September 15 cloture vote. Below is what changed in the last 48 hours, what the markets price going in, and three outcomes with price levels attached.
Key facts, all sourced
- Vote time: "At approx. 2:15pm the Senate will vote on the motion to invoke cloture on the motion to proceed to Cal. #423, H.R.3633 Digital Asset Market Clarity Act" - Senate Democrats floor schedule, published 14 September 2026.
- Threshold: 60 votes to invoke cloture; Republicans hold 53 seats (CoinDesk, crypto.news, 15 September).
- XRP spot $1.40, market cap $87.80bn, 24-hour volume $4.26bn - CoinGecko, 09:06 UTC 15 September. Binance XRP/USDT 24-hour range $1.3808 to $1.4961, last $1.3965 (Binance API, 09:05 UTC).
- Polymarket "Clarity Act signed into law in 2026?": 18.5% yes, bid 18 / ask 19, one-day change minus 12 points, $17.4m traded - Polymarket, 09:03 UTC.
- Final Republican text released 14 September with "126 substantive changes made at the request of Democrats" - Senators Lummis, Boozman and Scott.
- Democratic counteroffer delivered late Monday, hours before the vote; full text not public as of early Tuesday - Politico's Jasper Goodman, via crypto.news; CoinDesk.
What the Senate actually votes on at 2:15pm
Today's roll call is a cloture vote on the motion to proceed. If 60 senators agree, debate on the motion is limited and the Senate can take up the bill itself. It does not pass the CLARITY Act, and it does not fix the final text. According to the sponsors' own release, "if cloture is invoked on the motion to proceed on Tuesday afternoon, this legislative text would be offered as an Amendment in the Nature of a Substitute" - meaning the 14 September draft becomes the version the Senate debates and amends from there.
The arithmetic is the whole story. With 53 Republican seats, the bill needs at least seven votes from across the aisle even if every Republican votes yes, and crypto.news coverage on 4 September named Rand Paul and Josh Hawley as expected Republican no votes, which would push the Democratic requirement toward nine. Senator Thom Tillis had conditioned his support on stronger ethics language - the language the final text now says it includes.
What changed in the last 48 hours
Republicans published what they call the final text. On 14 September, Banking Digital Assets Subcommittee Chair Cynthia Lummis, Agriculture Chairman John Boozman and Banking Chairman Tim Scott released a draft they say reflects "substantially all of the Tillis-Gallego ethics proposal, including a meaningful role for state attorneys general in enforcement", gives the Treasury Secretary authority to act on deposit flight into payment stablecoins, and edits the Blockchain Regulatory Certainty Act developer provisions. Lummis framed the vote as a test of the other side:
"Democrats got what they wanted; now they need to take yes for an answer." - Senator Cynthia Lummis (R-WY), press release, 14 September 2026
The ethics piece rests on the White House: FinanceFeeds reported yesterday that Trump agreed to 80% of the stricter ethics rules tied to the bill.
Democrats answered with a counteroffer, not a yes. Senate Democrats delivered it to Republican negotiators late on Monday, and its text had not been released as of early Tuesday (Politico's Jasper Goodman, via crypto.news). CoinDesk reports the open points sit in the ethics section: concern that the revised language would still block state attorneys general from suing the president directly, and that it lets the Office of Government Ethics issue notices allowing senior officials to keep crypto business ties. The White House's crypto adviser Patrick Witt played the gap down, telling CoinDesk that "if there are any changes, we're talking about punctuation at this point."
The states pushed from the other side. On Monday, 18 state attorneys general urged the Senate to reject the CLARITY Act without changes - a second line of opposition going into the vote.
What the markets price going in
The clearest signal is the collapse in the law-in-2026 contract. At 09:03 UTC Polymarket showed 18.5%, with the platform's own one-day change field at minus 12 points - so the market marked the bill down sharply after the final text and the Democratic counteroffer landed, not up. With $17.4m traded, it is by far the most active Polymarket contract on the bill. Note what it measures: signature into law by the end of 2026, which requires far more than today's procedural vote.
Not everyone reads that pessimism as a reason to stay out. Bernstein's team led by Gautam Chhugani wrote that "any positive surprise is definitely not priced in", as quoted by TECHi on 14 September - the note identified seven to ten Democrats it considered potentially supportive.
For XRP itself, Polymarket's weekly "What price will XRP hit September 14-20?" event priced, at 09:06 UTC, a move to $1.50 at 35.5 cents and $1.70 at 5.35 cents, against a dip to $1.30 at 31.5 cents and $1.20 at 9.5 cents. Treat these as indicative only: the whole event has traded about $4,700, a fraction of the bill contract, and several strikes carry only a few thousand dollars of liquidity.
XRP into 20 September: three outcomes of today's vote
| Scenario | What happens at 2:15pm ET | XRP level to 20 Sep | Anchor |
|---|---|---|---|
| Bear | Cloture fails and Democrats hold out on the ethics section | $1.20 (14% below spot) | Polymarket weekly dip-to-$1.20 strike, 9.5 cents; below the $1.3808 24-hour low on Binance |
| Base | Vote slips, or cloture fails narrowly with talks on the counteroffer continuing | $1.40 to $1.50 | Current spot to the $1.4961 24-hour high (Binance); Polymarket $1.50 strike at 35.5 cents |
| Bull | Cloture invoked with 60 or more votes; the 14 September text becomes the substitute | $1.70 (21% above spot) | The late-August spike toward $1.70 (TradingView, per FinanceFeeds 2 Sep); Polymarket $1.70 strike at 5.35 cents |
Why the bear case is not lower: a failed cloture vote does not formally kill H.R.3633 - leadership can bring the motion back - and XRP's demand this year has not depended on the bill. Why the bull case is not higher: invoking cloture only opens debate. The law-in-2026 contract at 18.5% says the market expects more hurdles after today even if this one is cleared.
Why the vote matters less for XRP than the headlines say
The US spot XRP ETFs already exist and trade without CLARITY on the books, so today's vote cannot switch them on or off. What it changes is the durability of the regulatory tailwind. The supply side has not moved either: Ripple released 1bn XRP from escrow on 1 September and re-locked 700m of it, in two transactions at 18:11 and 18:13 UTC that day, according to Whale Alert records cited by CoinGape - the same 300m net monthly drip our 12-month XRP band of $2.35 bull and $0.90 bear is built on. The ETF side of that ledger is tracked in our XRP ETF flows piece.
So the honest framing for today is narrow. A cloture win would move the bill to the Senate floor, and XRP's move toward $1.50 in the last 24 hours shows traders were willing to front-run that. A loss would mostly confirm what the 18.5% contract already says. Either way, the level that decides XRP's 12-month path is still the roughly $1.87 cost basis of the US ETF complex, not the roll call.
Quick take: XRP goes into the 2:15pm ET cloture vote at $1.40 with the bill's law-in-2026 odds cut to 18.5%. Sixty votes means at least seven non-Republicans, and Democrats answered the "final" text with a counteroffer on the ethics section. A cloture win is the upside surprise the market is not priced for ($1.70 level); a failure points to a retest near $1.20; a delay or narrow miss keeps XRP in its $1.40-$1.50 range.
Frequently asked questions
What time is the CLARITY Act cloture vote on 15 September 2026?
The Senate Democrats' floor schedule for Tuesday 15 September lists the vote "at approx. 2:15pm" Eastern Time: a roll call on the motion to invoke cloture on the motion to proceed to Cal. #423, H.R.3633, the Digital Asset Market Clarity Act. The Senate recesses before it for the weekly caucus meetings, so the exact start can slip.
Does today's vote pass the CLARITY Act?
No. It is a procedural vote that needs 60 senators to move the bill toward floor debate. If cloture is invoked, the sponsors say the 14 September text would be offered as an Amendment in the Nature of a Substitute, and the Senate would then debate and amend it before any vote on passage.
What is XRP's price before the CLARITY Act vote?
XRP traded at $1.40 on CoinGecko at 09:06 UTC on 15 September, with a 24-hour range of $1.3808 to $1.4961 on Binance. It was up 39.5% over 30 days and down 52.9% over a year.
What are the odds the CLARITY Act becomes law in 2026?
Polymarket's "Clarity Act signed into law in 2026?" contract showed 18.5% at 09:03 UTC on 15 September, down 12 points in 24 hours, on $17.4m of trading volume. That contract prices final enactment, not today's cloture vote.
What could XRP do if cloture fails?
This piece's bear case is $1.20 by 20 September, 14% below spot, anchored on Polymarket's weekly dip-to-$1.20 strike (9.5 cents) and below the $1.3808 24-hour low. A failed vote does not formally end the bill, and XRP's ETF demand does not depend on it, which is why the bear level is not set lower.
Why are Democrats not on board with the final text?
Republicans say the text includes 126 changes Democrats requested. Democrats delivered a counteroffer late on 14 September; CoinDesk reports their concerns centre on the ethics section - whether state attorneys general could sue the president directly, and Office of Government Ethics notices that could let senior officials keep crypto business ties.
Analysis, not investment advice. Digital assets are volatile and you may lose your capital. Prices, prediction-market odds and the Senate schedule verified 15 September 2026 before the vote; the outcome of the 2:15pm ET roll call is not reflected in this article.
