Shares of Liquidia (LQDA) tumbled 57% during Wednesday’s trading session, finishing at $30.26. In after-hours trading, the stock edged up modestly by 0.13% to reach $30.30.
The dramatic decline came after a federal court decision issued in Delaware. The presiding judge determined that Liquidia’s pulmonary treatment Yutrepia violates a critical patent owned by competitor United Therapeutics (UTHR).
The court validated and found infringement on two specific claims from United Therapeutics’ intellectual property. Additional claims presented in the lawsuit were deemed invalid by the court.
The disputed patent encompasses treatment methods for pulmonary hypertension associated with interstitial lung disease, abbreviated as PH-ILD. The patent specifically addresses inhaled treprostinil administered via dry powder technology, which matches Yutrepia’s delivery mechanism.
Implications of the Court Decision for Yutrepia
The court additionally rejected Liquidia’s attempt to exclude evidence related to United Therapeutics’ patent ownership claims. The judge stated that Liquidia received adequate advance notice and failed to raise timely objections.
Liquidia acknowledged it cannot currently determine the financial impact of this decision. The ultimate consequences will depend on appellate proceedings and subsequent legal developments.
Potential outcomes range from eliminating the PH-ILD treatment indication from Yutrepia’s approved uses to implementing stricter marketing limitations. United Therapeutics has petitioned the court for an injunction that would restrict Yutrepia’s commercial distribution.
Both pharmaceutical companies must present proposed court orders within seven days. A final judgment is anticipated around the same timeframe.
Liquidia CEO Roger Jeffs expressed disagreement with the verdict. “We respectfully disagree with the Court’s decision regarding claims 1 and 14 and are fully prepared to pursue all available appellate options,” he stated.
Jeffs indicated that Liquidia will submit a supplemental filing to the FDA regarding Yutrepia’s approved labeling. The company’s objective is to voluntarily eliminate the PH-ILD indication from the drug’s official label.
Yutrepia received regulatory clearance in 2025 for treating two conditions: pulmonary arterial hypertension and PH-ILD. The PH-ILD application now faces legal challenges.
Analyst Reactions to the Verdict
Market analysts offered mixed assessments regarding the severity of the court’s ruling. Raymond James analyst Ryan Deschner characterized the rejected evidence motion as an unfavorable indicator for Liquidia’s overall legal position.
Leerink Partners characterized the outcome as favorable for United Therapeutics, noting the court validated both patent infringement and patent validity. RBC Capital’s Lisa Walter suggested the decision creates uncertainty around Yutrepia’s competitive market positioning.
United Therapeutics stock rallied 12% to $540.54 in response to the ruling. The decision strengthens intellectual property protections surrounding its leading inhaled therapy, Tyvaso.
Liquidia’s shares reached their lowest valuation in approximately four months following the announcement. If current losses persist, the company faces a potential market capitalization decline of roughly $3.18 billion.
Trading activity surged dramatically on the news. Transaction volume climbed to 22.95 million shares, representing nearly 19 times the typical daily average of 1.21 million.
Liquidia’s Relative Strength Index currently registers at 20.23, a threshold generally indicating oversold conditions. The stock now trades at approximately 12% of its 52-week price range.
Notwithstanding Wednesday’s significant decline, Liquidia shares remain 33% higher compared to twelve months ago. The company’s market capitalization currently stands at $2.71 billion, substantially below its 52-week peak of $93.61 per share.
