Shares of United Therapeutics (NASDAQ: UTHR) surged 13% on Wednesday following a federal court decision that sided with the biotechnology company in a protracted patent litigation. The stock changed hands around $543.86 per share, approaching its 52-week peak of $596.76 reached in May 2026.

A judge at the U.S. District Court for the District of Delaware determined that competing firm Liquidia Corporation violated two patent claims owned by United Therapeutics. These claims pertain to the treatment of pulmonary hypertension with interstitial lung disease through inhaled treprostinil delivery, including dry powder formulations.
Liquidia’s stock price collapsed following the announcement, dropping more than 50% during the trading session.
Details of the Court’s Ruling
The federal judge concluded that claims 1 and 14 of U.S. Patent No. 11,826,327 were both valid and infringed upon by Liquidia’s Yutrepia inhalation powder product. However, the court invalidated the remaining four claims that United Therapeutics had put forward in the litigation.
The parties must now submit their proposed legal remedies to the court within seven days. United Therapeutics has already requested injunctive relief through its post-trial submissions. Such relief could potentially restrict Liquidia’s ability to market Yutrepia in the future.
Yutrepia obtained FDA clearance in 2025 for treating both pulmonary arterial hypertension and PH-ILD. United Therapeutics initiated the legal action under the Hatch-Waxman Act, legislation designed to address patent conflicts between branded pharmaceutical manufacturers and generic competitors.
How Liquidia Is Responding
Roger Jeffs, CEO of Liquidia, stated that the company disputes the court’s findings regarding claims 1 and 14. He confirmed that Liquidia will seek to overturn the decision through the appeals process.
Jeffs also indicated that Liquidia plans to file a supplemental submission to Yutrepia’s New Drug Application. The objective would be to completely eliminate the PH-ILD indication from the product’s approved labeling.
Liquidia acknowledged that it cannot currently quantify the financial ramifications of the court’s ruling. The company cited numerous uncertain factors, including the appellate proceedings and additional court actions that remain pending.
Potential scenarios range from Yutrepia receiving a more restricted label to facing more extensive market access limitations.
This isn’t the only notable movement in United Therapeutics shares recently. Just six days prior, the stock declined 4% after Goldman Sachs analyst Andrea Newkirk initiated coverage with a Sell recommendation.
Large single-day price swings are relatively uncommon for United Therapeutics stock. Over the past twelve months, shares have moved more than 5% in one day only five times, making this week’s rally particularly noteworthy.
Year-to-date, the stock has appreciated approximately 10%. An investor who allocated $1,000 to United Therapeutics five years ago would currently hold a position valued at approximately $2,947.
The legal proceedings now advance to the remedy phase, with both companies required to submit their proposed solutions by the end of the week.
