CFTC Uses CME Data in Legal Battle Over Bitcoin Perpetual Futures

The Commodity Futures Trading Commission (CFTC) is leveraging data from CME Group Inc. in its legal defense regarding the approval of Kalshi's Bitcoin perpetual futures contract. The CFTC argues that CME has not suffered any harm from the introduction of this new product, as evidenced by CME's own trading volumes and statements from its executives.

Kalshi's Bitcoin perpetual futures contract was approved by the CFTC on May 29, 2026, marking it as the first U.S.-regulated Bitcoin perpetual futures product. CME filed a lawsuit on June 18, 2026, contesting the classification of the product and the approval process used by the CFTC. The lawsuit is currently being heard by Judge Colleen Kollar-Kotelly, with the CFTC seeking to dismiss the case, although a ruling has yet to be made as of mid-October 2026.

CME's argument centers on claims that the CFTC bypassed standard regulatory procedures and that the approval threatens competition in the futures market. However, the CFTC points out that CME's Bitcoin futures volumes increased by 15.3% in August 2026 compared to May 2026, the month of Kalshi's approval. Furthermore, CME executives have indicated a lack of demand for perpetual contracts from institutional clients, suggesting that CME could launch its own perpetual futures product if desired.

The outcome of this case could have significant implications for the regulation of crypto derivatives in the U.S. If the CFTC successfully defends its approval and the court dismisses CME's lawsuit, it may pave the way for other exchanges to seek similar approvals for perpetual contracts, which currently occupy a gray area in U.S. financial law.
