      Clarity Act Faces Challenges in Lame Duck Congressional Session

      The Digital Asset Market Clarity Act, known as the CLARITY Act, is facing significant challenges as Congress enters its lame-duck session following the midterm elections. This legislation, which aims to establish clearer regulatory frameworks for digital assets, has already passed through several legislative hurdles but is now at risk of stalling due to competing priorities and political dynamics.

      The CLARITY Act, formally designated as H.R. 3633, seeks to delineate the jurisdictional responsibilities of the Commodity Futures Trading Commission (CFTC) and the Securities and Exchange Commission (SEC). Under the proposed law, the CFTC would regulate digital commodities, while the SEC would oversee investment contracts and securities. Additionally, the bill introduces registration requirements, disclosure standards, and anti-money laundering protocols for market intermediaries, providing a more structured regulatory environment for exchanges and brokers.

      Having been passed by the House in July 2025 with bipartisan support, the bill was advanced by the Senate Banking Committee in May 2026. However, it has not been voted on by the full Senate, as the August recess saw it effectively shelved amid other legislative priorities. Critics have raised concerns regarding consumer protection and illicit financing, which could complicate the bill's progress further during the limited time available in the lame-duck session, which typically runs from mid-November to late December.

      The outcome of the midterm elections may also influence the bill's fate, as a shift in control of the Senate could alter the legislative landscape. Without the passage of the CLARITY Act, the current regulatory environment for digital assets will remain fragmented, with companies often learning about prohibitions through enforcement actions rather than clear guidelines.
