      EU Regulators Investigate Binance for Unlicensed Operations

      European regulators are scrutinizing Binance Holdings Ltd. regarding its operations in the European Union, specifically whether the cryptocurrency exchange has been serving EU customers without the necessary licensing under the Markets in Crypto-Assets (MiCA) framework. The inquiry involves the European Securities and Markets Authority (ESMA) along with national authorities from France, Germany, and Greece, focusing on a potential legal loophole that Binance may be exploiting to continue its services in the region.

      The MiCA framework requires firms to obtain authorization to operate across EU member states, but it includes a 'reverse solicitation' exemption. This exemption allows non-EU firms to serve clients who independently seek their services. However, regulators are questioning the validity of Binance's reliance on this exemption, as ESMA has indicated that it should be interpreted narrowly.

      In June 2026, Binance withdrew its application for a MiCA license in Greece, just before a deadline that required unlicensed firms to begin winding down operations in the EU. This withdrawal followed concerns about the company's compliance with regulatory standards, including its anti-money laundering controls. Since then, Binance has limited new client onboarding and restricted certain services for users in various EU countries while stating its intention to seek licensing in other jurisdictions.

      If regulators determine that Binance's use of the reverse solicitation exemption is improper, the exchange could face significant fines and may be compelled to limit its services to EU customers until it secures the necessary authorization. Such a ruling could also set a precedent for enforcement actions against other unlicensed cryptocurrency platforms operating within the EU, potentially increasing compliance costs for exchanges in the region.
