      Kalshi Faces Legal Challenges Amid Surge in US Sports Betting

      In 2025, Americans wagered approximately $166 billion on sports, surpassing spending on movies, music, and museums combined, according to the American Gaming Association. This significant growth in the legal sports betting market has led to increased scrutiny of platforms like Kalshi, which operates as a federally designated market for event contracts, including those related to sports outcomes. Kalshi argues that its contracts are swaps regulated by the Commodity Futures Trading Commission, rather than traditional bets subject to state gambling laws.

      However, the legal landscape is complicated. A split among federal appeals courts has emerged regarding whether Kalshi's contracts are classified as swaps or unlicensed gambling. The Third Circuit previously sided with Kalshi in a case involving New Jersey, but more recent rulings from the Ninth and Sixth Circuits have gone against the company, allowing states like Ohio and Tennessee to enforce their gambling laws against it. This inconsistency creates uncertainty for Kalshi's operations, as its future may depend on the jurisdiction of its users.

      In addition to state challenges, Kalshi is also facing lawsuits from tribal nations and consumer class actions. The Ho-Chunk Nation in Wisconsin is among those pursuing legal claims against the company. As traditional sportsbooks see a decline in usage—35% of bettors report using them less frequently—Kalshi's model poses a competitive threat, further complicating the regulatory environment. The outcome of these legal battles could significantly impact the future of sports betting in the United States, especially as states seek to protect their tax revenues from the burgeoning market.
