Thailand SEC Establishes Framework for Spot Bitcoin and Ether ETFs
Thailand's Securities and Exchange Commission (SEC) has announced a new regulatory framework for local spot Bitcoin and Ether exchange-traded funds (ETFs), which will take effect on October 16, 2026. The SEC issued 11 notifications on October 8, 2026, outlining the requirements for asset managers looking to launch these funds. However, no specific ETF products or issuers have been approved yet, as asset managers must first register their funds and obtain product approval before trading can commence.
The new framework mandates that these ETFs be passively managed and listed exclusively on the Stock Exchange of Thailand (SET). Each fund is required to maintain a minimum of 80% average net exposure to either Bitcoin or Ether. Additionally, fund assets must be held by digital-asset custodians that are licensed by the SEC, ensuring a high standard of custody for investors.
Investor protections are also a key component of the new rules. Buyers will need to complete an investor education program and acknowledge the risks involved before they can trade the ETFs. Furthermore, securities firms are prohibited from offering margin lending for ETF purchases, and retail access to foreign crypto ETF-linked structures is initially restricted. This approach aims to prioritize domestic investment while maintaining stringent custody and risk management standards.
