U.S. Congressman Expands Investigation into Prediction Market Insider Trading

Rep. James Comer, the Republican chair of the House Oversight and Government Reform Committee, has expanded a congressional investigation into potential insider trading on prediction market platforms, specifically targeting Polymarket and Kalshi. The investigation was initiated on May 22, 2026, following allegations that a soldier used classified information to profit over $400,000 through suspicious trades on these platforms. Comer has requested compliance records from the leadership of both companies, focusing on identity verification, trade restrictions, and logs of unusual trading activities, with a deadline for submission set for June 5.

The investigation has revealed over 80 trades on Polymarket that seemingly predicted significant geopolitical events before they were publicly announced. Notably, one trader achieved nearly $1 million in profits with a 93% success rate on bets related to U.S. military actions in Iran, placing wagers mere hours before official announcements were made. The case of Army Master Sgt. Gannon Ken Van Dyke stands out, as he was federally indicted in April 2026 for allegedly using classified information about a military operation in Venezuela to gain approximately $409,881 on Polymarket.

In response to the findings, Comer has indicated plans to propose legislation aimed at explicitly prohibiting government employees from trading on prediction markets that pertain to government actions using insider knowledge. While existing federal laws already prevent government employees from profiting from non-public information, prediction markets operate in a regulatory gray area. The Commodity Futures Trading Commission has recently begun to establish oversight for platforms like Kalshi, highlighting the need for clearer regulations in this emerging market.
