She emphasized that the bill had already integrated substantial modifications requested throughout bipartisan discussions.
The proposed legislation aims to provide definitive regulatory parameters for digital commodities while distributing supervisory authority between the Securities and Exchange Commission and Commodity Futures Trading Commission. The September 15 vote addressed whether senators would commence deliberation on the measure, not its ultimate approval.
Official voting records indicate every participating Democratic senator rejected cloture, joined by Republicans Susan Collins, Josh Hawley, Jerry Moran and Thom Tillis. Senator Chris Coons abstained from the vote.
Tillis cast his negative vote strategically to maintain procedural options for reconsidering the outcome. He submitted that motion immediately afterward, preserving Senate leadership’s ability to resurrect the legislation.

Legislation Retains Path Forward
The House chamber previously approved its iteration of the CLARITY Act with bipartisan backing. That legislation secured 294 affirmative votes, including support from 78 Democratic representatives.
The Senate setback therefore doesn’t terminate the larger initiative to establish federal cryptocurrency market structure regulations. Any Senate version diverging substantially from the House bill would ultimately require reconciliation between chambers before presidential consideration.
Industry stakeholders have cautioned that continued legislative stagnation could perpetuate uncertainty for cryptocurrency enterprises operating without comprehensive federal guidelines. As of September 23, no subsequent Senate cloture vote has been scheduled. The CLARITY Act maintains procedural viability while remaining politically deadlocked.
