CFTC Investigates Former Congressman Adam Kinzinger Over Prediction Market Trades

The Commodity Futures Trading Commission (CFTC) is investigating former Congressman Adam Kinzinger for trades he made on the prediction market platform Kalshi, specifically regarding contracts related to his potential presidential pardon from Joe Biden. These trades took place between December 2024 and January 2025, just before Biden issued a series of preemptive pardons as he concluded his presidency.

Kinzinger, who served as a Republican member of the House January 6 committee and retired from Congress in 2023, reported a profit of $823 from approximately 25 trades, most of which resulted in losses. He asserts that he had no insider information and adhered to Kalshi's trading rules prior to placing his bets. The investigation is particularly focused on the timing of his trades, which occurred shortly before Biden granted pardons to several individuals, including Kinzinger himself.

Kalshi's regulations prohibit trading on contracts where participants have influence over the outcome. The CFTC is examining whether Kinzinger's position could have disqualified him from trading on the contract related to his own pardon. This scrutiny follows previous enforcement actions by the CFTC against self-interested trading on the platform, highlighting ongoing regulatory challenges in the prediction market sector. As the investigation progresses, it remains unclear if Kinzinger's modest profit will lead to formal enforcement actions.
