CFTC's Caroline Pham Advocates for Broad Regulatory Authority Over Commodities

Caroline D. Pham, the former acting chairman of the U.S. Commodity Futures Trading Commission (CFTC), has asserted that the agency possesses the authority to regulate nearly all commodities, including digital assets, under existing law. In an interview on October 12, 2026, Pham highlighted that the Commodity Exchange Act (CEA) grants the CFTC jurisdiction over virtually every commodity, with the notable exceptions of onions and movie box office receipts.

Pham's comments come as the CFTC is in the process of drafting new rules for retail trading of cryptocurrencies, including transactions involving borrowed funds. She expressed support for the agency's recent proposals aimed at protecting retail crypto traders, describing them as essential safeguards. These proposals were initiated following an advanced notice of proposed rulemaking issued by the CFTC on October 5, 2026, which seeks public feedback before formalizing new regulations.

During her tenure at the CFTC, which included a period as acting chairman from January 2025 to December 2025, Pham oversaw the launch of a digital assets pilot program that utilized Bitcoin (BTC), Ethereum (ETH), and USD Coin (USDC) as collateral in derivatives markets. Her time at the agency also coincided with a significant reduction in enforcement actions, which fell nearly 80% in 2025 compared to the previous decade, alongside a 21% decrease in staffing. Current CFTC Chairman Michael Selig is now advancing frameworks for retail digital asset transactions, including margined and leveraged trading.
