Solana Policy Institute President Warns of Long-lasting Crypto Regulations

Kristin Smith, president of the Solana Policy Institute, has cautioned that the regulatory framework for cryptocurrencies being established in the next two years may be difficult to change. Speaking in early October 2026, Smith highlighted that rules finalized by the U.S. Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) before summer 2028 could become entrenched, especially following Congress's failure to pass a market structure bill.

Smith's concerns are based on the typical timeline for agency rulemaking, which she estimates at 18 to 24 months. This timeframe aligns closely with the Congressional Review Act, which limits the period Congress has to overturn new regulations. If rules are implemented within this window, reversing them would become increasingly challenging as businesses adapt to the new framework.

The urgency of the situation is underscored by the recent failure of the Clarity Act in the U.S. Senate, which aimed to clarify the regulatory responsibilities of the SEC and CFTC regarding cryptocurrencies. With Congress unable to act, the two agencies have taken the lead in shaping the regulatory landscape. Smith noted that previous successful policy changes, such as the GENIUS Act, demonstrate that agency actions can create lasting impacts on the industry.

In response to the evolving regulatory environment, the Solana Policy Institute has actively engaged with policymakers, conducting over 300 meetings in 2026. Smith has also taken on the role of interim CEO of the Blockchain Association while continuing her work at the Solana Policy Institute. The focus now shifts to ensuring that any forthcoming regulations are favorable and finalized promptly, as the industry faces a critical period leading up to 2028.
