UK Court Ruling Affects Claims to $5 Billion in Seized Bitcoin

A recent ruling by the High Court in the United Kingdom has significant implications for the government's claim to a substantial Bitcoin hoard valued between £3.8 billion and £5 billion. Justice Mark Turner determined that Chinese law will govern the property claims of victims in the Zhimin Qian fraud case, which involved the seizure of approximately 61,000 Bitcoin.

This decision, made around October 12-13, 2026, means that victims may have limited options to argue for a share of the Bitcoin's increased value since its acquisition. The ruling is preliminary and does not resolve the ultimate ownership of the Bitcoin, but it establishes the legal framework for upcoming civil recovery proceedings, which will include expert evidence on how Chinese law addresses such claims.

The fraud scheme, which ran from 2014 to 2017, deceived over 128,000 individuals in China, resulting in losses estimated at around £600 million. Zhimin Qian, the perpetrator, was sentenced to 11 years and 8 months in prison in November 2025, while her accomplice received a sentence of 4 years and 11 months for money laundering. The seized assets are currently under the control of the UK government as the legal process continues, with the Crown Prosecution Service working to secure them for the state.

Victims' representatives, including the law firm Fieldfisher, plan to appeal the ruling, which is expected to be heard in 2027. The outcome of this appeal could significantly impact the claims of the victims, potentially allowing for a larger recovery based on English law rather than the limitations imposed by Chinese law.
