European Commission Reviews MiCA Regulations Amid Compliance Concerns

The European Commission is currently reviewing the Markets in Crypto-Assets Regulation (MiCA) as it faces its first significant evaluation since implementation. The public consultation, which began on May 20, 2026, has been extended to September 30, allowing industry stakeholders, national regulators, and the public to provide feedback on the regulation's effectiveness and impact on the crypto market.

MiCA was designed to establish a comprehensive regulatory framework for crypto-assets in the European Union, with stablecoin regulations taking effect on June 30, 2024, and broader rules for crypto-asset service providers (CASPs) following on December 30, 2024. However, as of September 1, 2026, the results indicate that while 39 e-money tokens have been issued, there are currently no authorized asset-referenced tokens, which include stablecoins backed by various assets or commodities.

The European Banking Authority (EBA) has also weighed in, suggesting on September 24, 2026, that the Commission should enhance regulations concerning multi-issuer stablecoins and clarify definitions within the MiCA framework. This recommendation highlights the complexities and supervisory challenges posed by stablecoins that involve multiple entities in maintaining their value.

The feedback gathered during this consultation period will inform reports due by June 2027, which could lead to legislative amendments. The MiCA framework's passporting mechanism, allowing firms to operate across EU member states with a single license, remains a key advantage. However, the lack of authorized asset-referenced tokens raises questions about the regulation's effectiveness and future direction.
