Switzerland's FINMA Approves First Retail Spot Bitcoin ETF

The Swiss Financial Market Supervisory Authority (FINMA) has granted approval for the country's inaugural retail spot Bitcoin exchange-traded fund (ETF), enabling the fund to invest directly in Bitcoin in accordance with Swiss investment fund regulations. This decision marks a significant development in the Swiss financial landscape, particularly for retail investors interested in cryptocurrency.

On Tuesday, FINMA categorized the new ETF as an 'other alternative investment fund,' acknowledging the specific risks associated with such investments under Swiss law. The regulator highlighted Bitcoin's established trading history and substantial trading volume, which surpasses that of most other cryptocurrencies, as factors that justified exceptions to the typical diversification requirements for funds.

FINMA's approval follows its earlier endorsement of a crypto fund aimed at qualified investors in 2021. Unlike existing Swiss Bitcoin exchange-traded products (ETPs), which are classified as debt securities, this new ETF represents a shift towards more accessible investment options for the general public. The regulator has also outlined various safeguards related to custody, operational risks, and investor disclosures to protect participants in this emerging market.
