The price surge occurred amid evolving regulatory developments. Earlier this month, the CLARITY Act encountered obstacles in the Senate, preventing advancement of the proposed cryptocurrency regulatory framework.
On September 25, SEC staff released guidance addressing several key areas including token repurchase programs, staking reward mechanisms, network maintenance procedures, and marketing representations. This guidance remains informal and does not establish binding legal precedent, nor does it provide direct classification for XRP.
Regulatory Guidance Breakdown
According to the staff guidance, token buyback programs involving non-security digital assets on operational networks don’t automatically indicate promised managerial involvement. Additionally, specific types of staking receipts might be classified as digital commodities instead of securities, contingent upon their issuance structure.
Standard network upgrades and promotional activities surrounding existing network functionality may not fall under investment contract scrutiny based on the updated guidance. Cryptocurrency analyst Crypto Rover shared insights on social platforms, noting that liquid staking tokens are now being categorized as digital commodities rather than securities, while token repurchase programs on functioning protocols aren’t being interpreted as management-driven activities.
Prediction platform Kalshi published a September price target for XRP at $1.70, reflecting a $0.10 increase from its previous estimate. The platform simultaneously offers a separate contract monitoring whether XRP will surpass $1.70 before September 30.
Institutional Investment Flow
United States-based spot XRP exchange-traded funds registered $22.65 million in net inflows on September 25, based on data from SoSoValue. Bitwise dominated with $18.39 million, capturing approximately 81% of the day’s total inflows.
Franklin Templeton’s XRPZ product contributed an additional $4.26 million. The other three listed exchange-traded products reported zero net flow for that trading session.
These contributions elevated cumulative net inflows to $1.79 billion. Total combined assets under management reached $1.77 billion, representing roughly 1.80% of XRP’s overall market capitalization.
Trading volume across all five funds totaled $57.75 million, with Bitwise’s product responsible for $37.07 million. The previous day, September 24, witnessed $14.89 million in combined inflows across the five funds, preceded by $23.17 million on September 23.
Bitwise’s fund holdings stood at 401.42 million XRP tokens as of September 23, reflecting an increase of 14.18 million tokens over a two-day period. The position’s value reached approximately $613.89 million according to the fund’s official documentation.
Market analyst Ali Charts highlighted significant accumulation patterns among large-scale holders, observing that whale addresses acquired over 470 million XRP during a five-day window, representing approximately $724 million in value, while a potential inverse head-and-shoulders formation develops on the daily chart.
XRP reached $1.60 during the week before retreating to $1.5535 by 08:41 UTC Saturday. Four-hour chart analysis reveals resistance at the $1.60 level, which has repeatedly prevented further upward movement during recent trading sessions.
A sustained close above $1.60 would potentially establish a pathway toward $1.65, followed by $1.70. Support is currently established near $1.50, a level that provided stability following September 23.
A breakdown below $1.50 could potentially test $1.45. The four-hour Relative Strength Index currently registers at 52, marginally above the neutral 50 threshold, while the MACD indicator remains positioned below its signal line, suggesting diminishing short-term momentum.
