      Apple’s $5.7 Billion Loss Has a Hidden Beneficiary

      A San Diego federal jury awarded Taction Technology more than $5.7 billion on September 25 after finding Apple's Taptic Engine infringes two haptics patents, CNBC reported. Litigation funder Burford Capital then disclosed it could receive $1.4 billion of the award if Apple pays in full, sending Burford shares up more than 9% in London trading, according to 9to5Mac.

      A Hidden Funder Behind One of the Largest Patent Verdicts

      Taction Technology sued Apple in 2021 in the US District Court for the Southern District of California, alleging that Apple's Taptic Engine used its patented vibration technology without authorization. Apple won dismissal in 2023, but the US Court of Appeals for the Federal Circuit revived the case in 2025, ruling that the lower court had improperly excluded Taction's expert testimony. Trial began September 14, and the seven-member jury deliberated for two days before returning the verdict.Court records show Taction received financing from Gronostaj Investments LLC and Kenosha Investments LP. Kenosha has been identified in separate litigation as an indirect subsidiary of Burford Capital, Bloomberg Law reported. Burford said it was providing the information because media coverage had already connected the company to the case. Quinn Emanuel is representing Taction, with partner Lance Yang serving as lead counsel.

      Burford's $1.4 Billion Comes With Its Own Warning Label

      Burford said in a market announcement that it could be entitled to $1.4 billion if the $5.7 billion verdict is ultimately paid in full. The amount would be split roughly equally between Burford's own balance sheet and its managed investment funds, according to 9to5Mac.Burford itself cautioned investors that the figure does not represent a final judgment or any cash proceeds received. The company warned that post-trial proceedings and appellate scrutiny could result in it recovering substantially less than the verdict amount or incurring a total loss on the investment. Large US patent awards rarely survive post-trial and appeals processes intact, Burford noted in its statement.Burford shares closed up 9.41% in London and gave the company a market capitalization of roughly £659.9 million, or approximately $875 million, 9to5Mac reported. The $1.4 billion potential entitlement represents a sum larger than the company's entire market value at the time of disclosure.

      A Verdict is Not a Payout

      The jury did not find Apple's infringement willful, which typically caps damages below what a willfulness finding would allow and gives Apple firmer ground on appeal.At $5.7 billion, the award ranks among the largest patent verdicts against any technology company, more than five times the roughly $1 billion Samsung was ordered to pay Apple in 2012 and well above most standard smartphone-component patent awards.Apple said it strongly disagreed with both the infringement finding and the damages, calling them unsupported by the facts. The company argued that its Taptic Engine is fundamentally different from Taction's technology. Apple has confirmed it will appeal to the Federal Circuit, the same court that revived the case in 2025, CNBC reported. The Taction case follows Burford's March 2026 setback, when a US appeals court overturned a $16 billion YPF award that had previously sent Burford shares down more than 40%.Apple's post-trial motions in the Southern District of California will determine whether the verdict stands as entered or is reduced before any appeal reaches the Federal Circuit. Patent litigation of this scale typically takes years to resolve through the appellate process. Burford's business model depends on the eventual recovery, making the post-trial proceedings the next material event for both the funder's share price and the broader litigation finance sector.
