California Governor Gavin Newsom Signs Law Banning Public…
California Governor Gavin Newsom signed legislation on September 27 prohibiting covered state and local public officials from issuing meme coins, establishing one of the clearest state-level restrictions on politicians launching speculative crypto tokens.Assembly Bill 2409, introduced by Assemblymember Avelino Valencia, prohibits a “public officer or public employee” from issuing a meme coin. The enrolled legislation defines issuance broadly as making a token available for public purchase, donation or exchange of value, regardless of whether it is promoted.The restriction covers state and local elected or appointed officers, including legislators and members of government boards and commissions. Covered public employees include state or local government employees with decision-making authority over bids and contracts.California defines a meme coin as a digital asset marketed or recognized primarily through associations with memes, public figures, fictional characters, current events, celebrities or social trends, where value primarily derives from public interest, speculation or community engagement.
Restrictions Extend to Crypto Platforms
AB 2409 goes beyond preventing California officials from issuing their own tokens.Digital-asset service providers will also be prohibited from listing for sale to California residents a meme coin issued on or after January 1, 2027 if it is offered by, or in partnership with, a federal public official or a California state or local public officer.That provision gives the law relevance beyond California politicians because it can restrict California residents’ access through covered service providers to newly issued tokens associated with federal officials.The California Attorney General can seek injunctions and disgorgement to enforce the restrictions. District attorneys, city attorneys and county counsel can also bring civil actions over prohibited issuance by covered California officials and employees.The bill received unanimous final legislative votes. California’s Senate approved it 40-0 on August 26, while the Assembly concurred in Senate amendments 78-0 the same day.The legislation was presented to Newsom on September 3 before receiving his signature on September 27.Political Tokens Face Growing Scrutiny
The legislation arrives after politician-linked cryptocurrencies became a larger issue in U.S. markets following the emergence of tokens associated with prominent political figures.Newsom explicitly referenced President Donald Trump’s meme coin when announcing the legislation, arguing that public officials should not use their positions for private financial gain. Those comments reflect Newsom’s political position; AB 2409 itself establishes broader rules applicable to covered officials rather than prohibiting one specific token.California lawmakers stated in the legislation that financial instruments issued or promoted by public officials can create conflicts of interest, potential pay-to-play arrangements and risks involving foreign influence.Importantly, AB 2409 is not a general California ban on meme coins. Private developers and communities can continue issuing such assets, subject to other applicable laws, and the platform restriction is specifically directed at covered politician-linked tokens issued from January 1, 2027.The measure instead creates an ethics and conflict-of-interest framework around the intersection of public office and crypto issuance.Its significance also extends beyond preventing officials from directly creating tokens. By restricting digital-asset service providers from listing qualifying politician-linked meme coins for California residents, the state is placing compliance obligations on intermediaries that provide market access.That distinction could become increasingly important if political figures continue experimenting with tokenized assets: California is not attempting to prohibit the broader meme-coin market, but it has now drawn a statutory boundary around the ability of public officials to participate in it.Source: FinanceFeeds
