Thailand Enacts Cryptocurrency Travel Regulations to Enhance Compliance

The Securities and Exchange Commission of Thailand (SEC) has approved new regulations requiring digital asset operators to verify ownership of self-custody wallets during crypto transactions. This travel rule mandates that operators retain transaction-related information for a minimum of five years, aimed at mitigating risks associated with money laundering and terrorist financing.

Pornanong Budsaratragoon, Secretary-General of the Thai SEC, highlighted that the regulations were developed following two rounds of public consultations, with the majority of stakeholders expressing support. The first draft was presented in March, followed by a notification draft in June, leading to the finalization of the travel rule.

In addition to the travel rule, the Thai SEC is exploring the expansion of access to regulated crypto products. Recently, the SEC proposed allowing intermediaries to offer specific crypto derivatives from regulated overseas exchanges to retail investors. Furthermore, draft rules for spot Bitcoin and Ethereum exchange-traded funds (ETFs) have been advanced, alongside consultations regarding foreign digital asset custodians for funds investing in cryptocurrencies. This initiative aligns Thailand with global regulatory trends, as the Financial Action Task Force (FATF) anticipates that a significant majority of jurisdictions will implement similar travel rule legislation by 2026.
