      CFTC Moves Forward with Crypto Regulations Following Senate Bill Failure

      The Commodity Futures Trading Commission (CFTC) has submitted a prerule on crypto asset transactions and markets to the White House Office of Management and Budget for review. This action indicates that the agency will proceed with regulatory measures without waiting for Congress to finalize legislation on crypto market oversight. The move follows the U.S. Senate's failure to advance the Digital Asset Market Clarity Act, known as the CLARITY Act, which fell short with a vote of 49-50 on September 15, 2026.

      CFTC Chairman Michael Selig had anticipated this outcome and directed staff to explore potential crypto trading rules as early as August 20, 2026. He described the Senate's inability to pass the bill as "unfortunate," emphasizing the need for clarity and consumer protections in the crypto market. The prerule is a critical step in the federal rulemaking process, allowing the CFTC to publish proposed regulations in the Federal Register once approved by the OMB, which will then open a public comment period before finalization.

      The CFTC is not alone in this regulatory push; the Securities and Exchange Commission (SEC) is also preparing to take independent action. SEC Chair Paul Atkins has indicated readiness for decisive regulatory measures, including a five-year conditional exemption for certain tokenized-stock platforms. Analysts expect both agencies to engage in rapid rulemaking following the legislative setback, although agency rules may lack the permanence of congressional legislation, as they can be challenged or reversed by future administrations.
