Circle’s USDC Gains Significant E-Money Token Status in…

The European Banking Authority has classified Circle’s USDC as the European Union’s first significant e-money token under MiCA, moving key parts of the $74 billion stablecoin’s supervision from France’s banking regulator to the EBA and subjecting Circle to stricter prudential requirements. The designation takes effect on November 12. From that date, the EBA will directly oversee USDC in areas including own funds, reserve assets, liquidity requirements and recovery and redemption plans, while France’s Autorité de Contrôle Prudentiel et de Résolution, or ACPR, will retain responsibility for governance, outsourcing, qualifying holdings, conflicts of interest and fit-and-proper assessments.USDC is the first of the 45 e-money tokens currently notified under MiCA to be classified as significant. Circle obtained its French electronic money institution licence in 2024, making USDC and EURC among the first major stablecoins authorized under the EU framework.

What Changes When USDC Becomes Significant?

MiCA reserves enhanced supervision for tokens whose scale, transaction activity, international use and links to the financial system make them more important to financial stability. The EBA reviews those significance conditions annually. The practical consequence for Circle is more than a change in regulator. Significant e-money tokens face additional liquidity, capital, stress-testing and reserve-management requirements designed to ensure an issuer can meet redemptions even during periods of market stress. One requirement is particularly important for USDC. MiCA’s liquidity framework can require issuers of significant e-money tokens to maintain at least 60% of the reserve associated with an official currency in deposits at credit institutions, compared with the 30% minimum applicable under the standard framework. That requirement arrives only weeks after Circle asked the European Commission to reconsider MiCA’s 30%-60% bank-deposit rules, arguing that mandatory commercial-bank exposure can increase credit and counterparty risk rather than make stablecoin reserves safer.

      Investor Takeaway

The designation strengthens USDC’s regulatory position in Europe, but it also subjects Circle to tougher reserve, liquidity and capital constraints.

Why Does the Reserve Rule Matter for Circle?

Circle’s USDC reserves totaled approximately $74.3 billion against $74.1 billion in circulation as of October 5. Globally, those reserves include bank deposits, short-dated U.S. Treasuries and overnight Treasury repurchase agreements.Circle has argued that forcing a larger share into commercial banks can create concentration and counterparty exposure that highly liquid government securities avoid. It has proposed replacing rigid deposit percentages with a broader liquidity standard and easing concentration limits that could require a large issuer to maintain relationships with numerous banks. The issue has also divided major stablecoin issuers from the European framework. Tether CEO Paolo Ardoino has said the company declined to seek MiCA authorization for USDT partly because of the bank-deposit requirement. The EBA itself recently called for aspects of MiCA’s reserve rules to be reviewed while maintaining effective risk controls, meaning Circle’s new classification arrives while policymakers are reconsidering parts of the framework it must now follow.

How Will Europe and the U.S. Share Oversight?

USDC presents an unusual supervisory problem because the same globally circulating stablecoin is issued through regulated entities on both sides of the Atlantic. Circle Internet Financial Europe SAS issues USDC in the EU, while Circle Internet Financial LLC issues it in the United States. To address that cross-border structure, the EBA has signed a memorandum of understanding with the New York State Department of Financial Services covering regulatory cooperation and information sharing. The arrangement matters because USDC tokens issued through different Circle entities remain part of a common global liquidity network. European regulators have increasingly focused on whether multi-issuer stablecoin structures can ensure that sufficient reserves and redemption capacity remain available inside the EU during periods of stress.

      Investor Takeaway

USDC’s scale is turning stablecoin supervision into a cross-border banking issue, requiring regulators to coordinate around reserves, liquidity and redemption capacity.

Does Significant Status Give USDC an Advantage Over USDT?

The classification is not a regulatory endorsement of USDC over competing stablecoins. “Significant” is principally a prudential category reflecting scale and potential financial-system impact, and it comes with additional obligations rather than lighter treatment.Commercially, however, Circle is increasingly positioned inside the EU regulatory perimeter while Tether’s USDT remains outside the MiCA authorization system. That distinction matters for European exchanges and financial institutions that must determine which stablecoins they can offer to customers.USDT remains substantially larger globally, but MiCA has created a European market in which regulatory eligibility can matter alongside market capitalization and liquidity. USDC’s move into direct EBA supervision takes that model another step further: Europe is no longer regulating the token merely as a crypto product, but increasingly as financial infrastructure large enough to warrant centralized prudential oversight.
