French Lawmakers Approve Amendment Taxing…
How Would France Tax Crypto-to-Stablecoin Swaps?
Under existing French rules, qualifying cryptocurrency-to-cryptocurrency exchanges without an additional cash payment generally benefit from tax deferral. Taxable gains typically arise when investors convert digital assets into fiat currency or use them in taxable purchases. The amendment would remove that treatment for exchanges in which investors receive electronic money tokens, or EMTs, as defined under the European Union's Markets in Crypto-Assets Regulation (MiCA).That distinction is important because the proposal specifically targets stablecoins meeting the EMT definition rather than automatically treating every cryptocurrency transaction as taxable. For example, an investor who purchases Bitcoin for €20,000 and later exchanges it for qualifying stablecoins worth €30,000 could realize a taxable gain of €10,000, even without withdrawing money into a bank account. The legislation would also replace France's existing portfolio-wide capital gains calculation with an approach based on the acquisition cost of the particular crypto assets disposed of, including weighted-average purchase costs for assets of the same type.France's tax administration currently lists a 31.4% flat tax rate for private cryptocurrency capital gains in 2026, although the rate applicable to transactions in 2027 could change.FinanceFeeds previously examined the committee's approval of the stablecoin conversion tax and proposed crypto exit tax, both of which were initially targeted for implementation in January 2027.Investor Takeaway
The amendment would shift the taxable event forward from fiat conversion to certain stablecoin transactions. Investors could consequently face tax liabilities while their proceeds remain in digital assets, creating additional liquidity and recordkeeping requirements.
Why Does the Proposal Matter for Crypto Trading and Liquidity?
Stablecoins frequently serve as intermediary assets for cryptocurrency traders, allowing investors to reduce exposure to market volatility without transferring funds into traditional bank accounts.Removing tax deferral from qualifying conversions would change the economics of that strategy for French tax residents. Investors who regularly exchange Bitcoin, Ether or other cryptocurrencies into stablecoins could generate multiple taxable transactions throughout a year. The implications extend beyond individual investors. Exchanges and portfolio management services may need to provide more detailed transaction histories, acquisition-cost information and reporting tools to help customers calculate gains. The amendment could also influence which assets investors use when reallocating portfolios. However, any effect on stablecoin demand or trading volumes would depend on the final legislation and subsequent investor behavior.Importantly, the proposal does not establish a general tax on holding stablecoins. Its immediate focus is the treatment of gains realized when certain crypto assets are exchanged for qualifying electronic money tokens. What Other Crypto Tax Measures Are French Lawmakers Considering?
The stablecoin amendment is part of a wider examination of cryptocurrency taxation, including proposed changes to exit taxes and self-custodial wallet reporting. One proposal, Amendment I-3432, would extend France's exit-tax framework to unrealized cryptocurrency gains when qualifying taxpayers transfer their tax residence abroad with crypto portfolios exceeding €800,000.It would generally cover individuals who had been French tax residents for at least six of the preceding ten years, while incorporating payment-deferral and relief provisions from the existing exit-tax system.A separate proposal, Amendment I-2701, would introduce reporting obligations for directly held cryptocurrency wallets containing assets worth at least €100,000 at the relevant year-end.As FinanceFeeds previously reported, the wallet-reporting measure could expose noncompliant taxpayers to penalties of up to €10,000 if enacted. Neither proposal should currently be treated as an enforceable new obligation.Meanwhile, lawmakers rejected an amendment that would have allowed cryptocurrency capital losses to be carried forward for ten years. That proposal failed on October 16 by 18 votes to 75, with three abstentions.Investor Takeaway
The proposals address three different risks for cryptocurrency holders: taxation of realized gains, potential liabilities when changing tax residence, and disclosure of privately controlled assets. Their eventual impact depends on which provisions survive the budget process.
What Happens Before the New Rules Can Take Effect?
The National Assembly's October 20 vote on the first part of the 2027 Finance Bill is the next scheduled legislative milestone. Approval of an individual amendment does not guarantee its inclusion in the final budget. The legislation must proceed through further parliamentary stages, including Senate consideration, before becoming binding law. The stablecoin amendment could still be revised or removed.Separately, France is preparing for expanded cryptocurrency tax transparency under the European Union's DAC8 framework. As FinanceFeeds examined in its coverage of crypto tax reporting, the rules require covered service providers to collect transaction and customer identification data from 2026, with reporting beginning in 2027.That reporting infrastructure could give tax authorities greater visibility into transactions that would become taxable under the proposed amendment. For French cryptocurrency investors, the immediate issue is therefore legislative uncertainty rather than a new tax obligation. The final text will determine whether stablecoin conversions become taxable from January 2027 and how the revised acquisition-cost rules operate.Source: FinanceFeeds
