      Thailand's SEC Establishes Framework for Bitcoin and Ether ETFs

      On October 8, 2026, Thailand's Securities and Exchange Commission (SEC) announced the finalization of rules governing exchange-traded funds (ETFs) based on cryptocurrencies. The new framework, which will take effect on October 16, 2026, includes 11 notifications that outline the operational structure for crypto ETFs, initially limited to Bitcoin and Ethereum as the only qualifying assets.

      The regulations stipulate that each ETF must be passive and track a single asset, maintaining at least 80% net exposure to its underlying cryptocurrency throughout the accounting year. Additionally, the cryptocurrencies must be held by onshore custodians supervised by the SEC, and the funds will exclusively trade on the Stock Exchange of Thailand (SET). Investors will not be permitted to use margin lending to purchase these ETFs.

      This move marks a significant shift in Thailand's approach to cryptocurrency investment, transitioning from reliance on foreign products to developing domestic offerings that adhere to local regulations. The SEC has emphasized investor protections, including risk education and suitability assessments, to ensure that buyers are well-informed about their investments.

      As asset managers prepare to launch these ETFs, the focus will be on how quickly they can secure the necessary approvals and bring their products to market. The SEC has indicated that while Bitcoin and Ethereum are the initial assets allowed, there may be potential for expanding the list of eligible cryptocurrencies in the future, depending on regulatory considerations.
